Welcome to HTYRE.com. This Site and domain name are owned and operated by H TYRE PTE. LTD., Company Registration No. 200205950C ('H Tyre'). These Terms and Conditions (the "T&Cs") apply to www.htyre.com (the "Site") and form the terms and conditions on which we supply products and services to you. By accessing or using the Site, you acknowledge that you have read, understood, and agreed, without limitation or qualification, to be bound by these Terms & Conditions which include our Privacy Policy.

1. ACCESS TO AND USE OF THE SITE
​
As a condition of your access to and/or use of the Site, you warrant that: (a) all information supplied by you on the Site is accurate, current and complete; (b) you are 18 years of age or older in order to access and/or use the Site; and (c) you will not copy or distribute any part of the Site in any medium without H Tyre’s prior written authorization.
You shall be solely responsible for your access to and/or use of the Site and its materials herein.
Where you create a user account and password, you must treat such information as confidential, and you must not disclose it to any third party. We reserve the right to refuse service and/or terminate accounts without prior notice if you violate these T&Cs or if we decide, in our sole discretion, that it would be in H Tyre’s best interests to do so.

2. PRICING
The price payable by you for the Product shall be the price of the Product listed for sale as stated on the Site at the time your order is transmitted to us through the Site, and any applicable taxes. Prices listed on the Site for Rims (Rota, Mahom Forged, SSR) are denoted as per piece pricing. All prices are subject to taxes, unless otherwise stated. Prices stated on the Site are only valid for online purchase, in-store prices at our workshop may vary. We reserve the right to amend the price of any Product at any time without giving any reason or prior notice. Please complete payment within two hours from the time your order was placed. All unpaid orders after this payment time-frame will be cancelled automatically. In the event that any Product has been mispriced on the Site, we reserve the right to terminate the Order and notify you of such termination, regardless of whether or not the products have been dispatched or are in transit and whether payment has been charged to you.

3. ORDERS & PAYMENTS
​
You may place an order with us by completing and submitting the order form on the Site. You shall be responsible for ensuring the accuracy of all orders. All orders will be deemed to be irrevocable and unconditional upon transmission through the Site, and we shall be entitled, but not obliged, to process such order(s) without your further consent and any further reference or notice to you.

We reserve the right to accept, to limit the order quantity of any item or decline any and all orders received from or through the Site in our sole and absolute discretion. Our acceptance of your order will take place when a confirmation email is sent to your registered email address with us, at which point a contract will come into existence between you and us. Each fully-paid order accepted by us shall constitute a separate and individual contract governed by these T&Cs (an "Order"). We will assign an order number to your Order when we accept your Order. Please tell us the order number whenever you contact us about your Order.

If we are unable to process your order, we will inform you of this. This might be because the product is out of stock, because of unexpected limits on our resources for which we could not reasonably plan, because a credit reference we have obtained for you does not meet our minimum requirements, because we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline you have specified.

4. ACCURACY OF INFORMATION
​
We attempt to be accurate as reasonably possible in our descriptions of products available for purchase through the Site. However, our products may vary slightly from their pictures. The images of the products on our Site are for illustrative purposes only. Colours may appear slightly different in reality due to studio lighting conditions, or variances in computer screen calibration. We do however strive to ensure that screen colours are true to life, as much as possible. We do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.

5. EXCHANGE, RETURN AND REFUNDS
​
All products, once sold are non-returnable. However, exceptions will be made for wrong or damaged products provided they are reported within 3 days upon receiving of goods. H Tyre reserves the right to request for photo evidence. Our Customer Service Officer will arrange to deliver the incorrect/damaged item(s). All products to be exchanges must be returned to us in their original condition/packaging and must be accompanied with the sales invoice with the date of purchase and serial number clearly printed on it for verification. If we accept your return, we will make any refunds due to you as soon as possible and generally within 14 days from the day on which we receive the returned Product. If the replacement piece is no longer in-stock, store credit or a refund will be issued.

6. DELIVERY
​
H Tyre will deliver to the address indicated by you within Singapore. H Tyre can only deliver to a delivery address which is a home or office address. Deliveries will be done on business days, not being a weekend or a public holiday. Delivery times will be arranged with you in advance. All delivery dates provided by us are estimates only. If delivery of your Product is delayed, we will inform you accordingly and the Product will be dispatched after it becomes available. The time for delivery shall not be of the essence, and neither we nor our agents shall be liable for any delay in delivery howsoever caused.

You are responsible to ensure that a person will be present during the delivery of the products. If the order is undeliverable, the products will be returned to our warehouse and you will be charged for the transport fee for re-delivery. Alternatively, customer can choose to self-collect at H Tyre in which our Customer Services Officer will advise a ready-to-collect date for customer collection.
​
If there are any changes in the delivery address / contact details made between submission of order and delivery date, customers are to notify H Tyre at least 24 hours prior to delivery. Any late requests for a delay in delivery date and time will be subjected to a surcharge.

7. SELF COLLECTION
​
For self collection at our store, you or your representative is required to produce proof of identity (NRIC/Passport and Order Confirmation Email) on collection of products and you or your representative shall acknowledge receipt of the delivery.
Free installation of the product onto your vehicle can be provided on request for customers who opt for self collection at our store.
Order will be cancelled if you do not collect the product within 30 days from the date of purchase. No refund will be granted in such event.
We reserve the right to withhold delivery of the products to you if we have any doubts whatsoever as to your credit worthiness or insufficient identification.
No delivery charges apply for orders collected in selected store. However, we reserve the right to charge any reasonable delivery charges for any other special redelivery arrangement.

8. TERMINATION OF ORDER
​
We may terminate the Order at any time by writing to you if: (a) You do not make payment to us when it is due; (b)You do not, within a reasonable time of us asking for it, provide us with information necessary for us to provide you with the Product (e.g. delivery address); (c) You do not, within a reasonable time, allow us to deliver the Product to you.
​
If we terminate the Order in the situations set out above, we will refund any money you have paid in advance for Products we have not provided, but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.

9. LINKING AND THIRD PARTY CONTENT
​
The Site may contain links to third party websites that are not affiliated with or owned, operated, or controlled by H Tyre, including third party payment system providers. You acknowledge and agree that H Tyre is not responsible for the content, privacy policies, or practices of such third party websites or the companies that own them. By using the Site, you expressly relieve H Tyre from any and all liability arising from your access and use of any third party website.

We encourage you to review the terms and conditions and privacy policies of any third party websites before using them and disclosing your personal data to them.

10. APPOINTMENT BOOKING SYSTEM
​
In order to reduce waiting time at our workshop, please schedule an appointment at least 1 day prior to driving your vehicle to our workshop. Customers who have booked an appointment slot and arrive punctually will be given priority. Customers who arrive 10 mins after their scheduled appointment time will be deemed as walk-in customer and have to join the waiting queue.

All appointments applied on our Appointment Booking system are on a first-come, first-served basis and subject to availability of service slots, resources and acceptance by us. We reserve the right to reject any application at our discretion.
​
If you wish to cancel or change an existing appointment, you must inform us at least 1 day in advance by sending an email to sales@htyre.com or call us at 6293 3636.
​
On the day of your appointment, for verification purposes, you must bring along a valid form of identification (i.e. NRIC) and show the confirmation email as may be requested by us. We also reserve the right to conduct additional verifications at our discretion.
​
We may also from time to time withdraw, suspend, change or terminate any part or whole of the Appointment Booking system at our discretion.
​
H Tyre reserves the right to terminate customers who failed to show up for their booked appointments from any future usage of the Appointment Booking system.
​
11. INTELLECTUAL PROPERTY RIGHTS
​
All intellectual property rights in and to the content on the Site, and the materials are owned and licensed by H Tyre. We reserve the right to enforce its intellectual property rights to the fullest extent of the law. You may not copy, reproduce, modify, republish, upload, post, transmit, adapt, download, distribute or howsoever deal with any content or material from the Site in any form or by any means without H Tyre’s prior written permission, and you are solely responsible for obtaining such permission before dealing with any content or material that is available on the Site.

12. WARRANTIES AND LIABILITY
​
The Site, its services and all information provided herein are provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied, other than those imposed by law, including but not limited to warranties of title or implied warranties of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement.

Without prejudice to the generality of the foregoing, we expressly disclaim any warranty, condition, guarantee, term or representation (a) as to the accuracy, timeliness, completeness, and validity of any content or material on the Site; (b) that the functions contained on the Site will be secure, uninterrupted or error-free; and (c) that any defects will be corrected. Any and all such warranties, conditions, terms and representations are specifically excluded. We assume no responsibility for errors or omissions in the materials on the Site, including factual or other inaccuracies or typographical errors. You expressly agree that your use and/or access of the Site is at your sole risk.

You further acknowledge and agree that your access and use of the Site is dependent on third party service providers such as internet, network, connectivity or other link providers. Your payment for any Product purchased from the Site is processed by third party payment system providers and H Tyre does not retain or process any such payment information. H Tyre cannot guarantee the security of such third party payment system(s) or any payment data on the Site, H Tyre is not responsible for any acts or omissions of any third parties and disclaims any and all liability in connection with the acts, omissions or defaults of such third parties. Without prejudice to the generality of the foregoing, H Tyre is not responsible for the results of any credit inquiry, the availability or performance of the Internet, your connection to the Internet or the actions or inaction of any other person or entity, including any internet service provider. By using the Site, you expressly relieve H Tyre from any and all liability in connection with the acts, omissions or defaults of such third parties. Any risk of misunderstanding, error, damage, expense or losses resulting from the use of the Site is entirely at your own risk and we shall not be liable therefore.

To the extent that any exclusion of liability under these T&Cs is not permitted by law, the aggregate cumulative liability of H Tyre under any Order shall in any event not exceed the sum that you have paid to us for the sale of products under that Order.

13. INDEMNITIES
​
You agree to indemnify us and hold us and our partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives harmless from any claims, losses, and damages, including reasonable attorneys’ fees, arising out of your access of, use of and/or participation in this Site, including (i) any claims of infringement of a third party’s rights; (ii) damage to tangible property, bodily injury, or death; (iii) negligence or willful misconduct caused or attributable to you or any of your agents, and (iv) breaches of your obligations under these T&Cs.

14. TERMINATION
​
If you violate any of these T&Cs, your permission to use the Site may be suspended or revoked, and we reserve the right to suspend or terminate your access to and use of the Site at any time.

15. FORCE MAJEURE
​
We shall not be liable for any breach of our obligations under this Agreement where we are hindered or prevented from carrying out our obligations by any cause outside our reasonable control, including by lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, act of God, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any law, accident (or by any damage caused by any of such events).

16. DATA PROTECTION

17. APPLICABLE LAW
​
The Terms of Use and the provision of our services shall be governed by and construed in accordance with the laws of Singapore without reference to Singapore conflict of laws rules, and any dispute arising out of the Terms of Use and our services shall exclusively be submitted to the competent courts in Singapore. Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights.

18. AMENDMENTS
​
H Tyre reserve the right to amend this Terms and Conditions at any time without prior notice. Any changes we may make to this Terms and Conditions in the future will be posted on our website. You are encouraged to review this page periodically to see any updates or changes to our Terms and Conditions. H Tyre reserves the right to make any changes to the Site or to discontinue any aspect or feature of the Site without notice.
